State Abortion Laws: A Featured Controversy from Issues & Controversies

November 18, 2021
Pro-choice and pro-life activists protest outside the U.S. Supreme Court as it hears oral arguments in a case involving a Louisiana abortion law in March 2020.

Featured in Issues & Controversies:
STATE ABORTION LAWS: Should States Restrict Abortion Access?

Should states pass laws restricting access to abortion? Be sure to check out Issues & Controversies’ complete and unbiased coverage of this divisive issue. Here is a sample of the pro/con arguments on both sides of the issue.

SUPPORTERS ARGUE OPPONENTS ARGUE
Abortion restrictions protect the lives of unborn children, prevent unsafe clinic conditions, and provide women with the information necessary to make a difficult decision. The state has an interest in protecting the fetus, which can feel pain and deserves constitutional protections. Most Americans agree with these restrictions. Abortion restrictions violate women’s right to privacy and control over their own bodies. By making the procedure more difficult to access, they will lead women to seek alternative, dangerous means of terminating pregnancies. Restrictions are often based on unproven theories of “fetal pain” and unfounded claims that abortion clinics are unsafe.

The pro/con article links to rich related resources that enhance the debate. Students and researchers can explore the “By the Numbers” data, primary sources that provide context, court cases, overview videos, NPR podcasts, infographics, editorials, a Reuters® newsfeed, a chronology, and a bibliography and further resources. Plus, discussion questions are provided to inspire critical thinking and analysis.
